TERMS OF SERVICE - PSYC® VISUAL

Welcome to PSYC® VISUAL. These Terms of Service (hereinafter referred to as “Terms”) govern your use of https://www.psycvisual.com (hereinafter the “Site”). The Site is owned and operated by PSYC® VISUAL, an individual business operating under the trade name PSYC® VISUAL.

Please read these Terms carefully before hiring or using our design services. By accessing or using this Site, you agree, on your own behalf or on behalf of your employer or any other entity (as applicable), to be bound by these Terms and by our Privacy Policy.

By accessing this Site, you acknowledge that you have read, understood, and agreed to these Terms at all times,
If you do not agree with these Terms or the Privacy Policy, you must not request or purchase any design services from PSYC® VISUAL.​

1. Pricing

Pricing is determined by multiple factors:

Complexity of desired style
Commercial rights or other specific uses

Prices are determined by the project’s complexity, usage rights, and specific requirements.
Every project is quoted individually, whether it’s for an underground brand or musician, a personal commission, or a larger company.
Please submit clear and concise project details when requesting a quote.
All pricing is quoted in USD (United States Dollar)

Generic inquiries without specific project details will not be considered.​​

Quote Validity:
All quotes provided by the Designer are valid for a period of 30 days. After this period, the Designer reserves the right to adjust the pricing based on current rates.

2. Payment & Delivery

Pre-Requisite:
No sketches, previews, or brainstorming will commence until the initial deposit or full payment has been successfully cleared.
Payment can be made in full or split 50/50 (50% upfront to start the project and 50% before the final file delivery).

Payments are accepted via PayPal and cryptocurrency (USDT, BUSD, ETH).

Bank Transfer: Bank transfer available upon request.


Final files are delivered via email with a permanent Google Drive link in PSD, PNG, PDF formats.
Additional formats can be requested at no extra cost.​

 

3. Revisions

Clients are kept informed throughout every stage of the project and may provide feedback as the work progresses.
The creative process begins after the initial payment is received; therefore, no sketches or previews are shared in advance.

Revisions are included within reasonable limits. However, major changes requested — especially those involving a new creative direction — may be subject to additional fees.

Revision Fees:
Should a project fall into "Major Revision" territory, an additional fee starting at $50 USD will apply, depending on the complexity of the requested changes.

Client Responsibilities:
The Client agrees to provide all necessary materials (e.g., content, imagery, brand guidelines), clear creative direction, and feedback in a timely manner to ensure efficient delivery.

4. Cancellation and Refund Terms

If the client decides to cancel the project after development has begun and ideas or proposals have already been submitted, a full refund will not be possible. The refundable amount will depend on the progress made, with only a portion of the total payment being returned.

For upfront payments: Refunds will be calculated based on the work completed, or simply 50% of the full amount will be returned.

For 50/50 payments: The first installment is non-refundable once work has started, as it covers time and resources already invested.


The project may be cancelled under the following circumstances:


If the client decides to discontinue the development at any stage.
If the designer chooses to terminate the project.
If the client becomes unresponsive — i.e., fails to reply to emails or project update messages for an extended period (weeks or months).

 
In the case of client inactivity:

If the client resumes communication after a prolonged absence without providing a reasonable or justifiable explanation, the designer is not obligated to resume the project or issue a refund.
If the absence is communicated and agreed upon in advance, the project may proceed as planned.


Designer-initiated cancellations are extremely rare and usually occur only in cases where the project has undergone an excessive number of revisions — beyond what is reasonably expected — without meeting the client's expectations. In any of the cancellation scenarios (whether initiated by the client or designer), the refund process will follow the terms outlined above.

If the client has made an advance payment, the project has been fully completed, and the client later chooses to abandon the project for any reason, no refund will be issued.

5. Confidentiality

The Designer agrees to maintain the confidentiality of sensitive information provided by the Client. If the Client requires temporary confidentiality throughout the project timeline, this must be discussed in advance. Should strict, ongoing confidentiality be required, the Client must supply a Non-Disclosure Agreement (NDA) for signature prior to the start of the project.

6. Intellectual Property and Usage Rights

Usage Rights:
Upon full payment of the final invoice, the Client will own full usage rights to the final approved deliverables and is free to use them for personal, commercial, or professional purposes across digital, print, and other applications.

Unused Concepts
The Designer retains full intellectual property rights, ownership, and copyright to all preliminary drafts, unused concepts, and unapproved sketches created during the process.

Exclusive Buyout:
If the Client requires strict confidentiality that prevents the Designer from showcasing the work publicly, an NDA and Buyout agreement must be arranged for an additional fee starting at $400 USD. This must be stated in the initial inquiry.

Third-Party Fonts & Asset Licensing:
While the Designer may source, recommend, or incorporate third-party assets (such as commercial typefaces, fonts, or stock textures) into the design, the Client is strictly responsible for purchasing the appropriate commercial end-user licenses for these assets under their own name or business entity. The Designer cannot legally transfer a personal font license to the Client for commercial, merchandise, or trademark use.

 

7. Changes To The Terms Of Service

We reserve the right to update or modify these Terms of Service at any time by posting changes on this page. It is your responsibility to review these Terms periodically. Continued use of the website or our services after any updates constitutes acceptance of those changes.
